PRIVACY POLICY

Introduction

At Compell’d®, we want to seamlessly enable people to lead a more fulfilled life by providing an all-in-one solution designed to help you easily discover, remember, share and (actually) do what interests you. In order to create the best possible service for our users, we collect, use, and share information and data, either provided by our users or generated by their usage of Compell’d®. This Privacy Policy describes what information and data we collect, as well as how we use it. By signing up to our mobile application, you accept the conditions of this Privacy Policy and the processing of your personal data as described in this policy.

References in this Privacy Policy to “we,” “us,” or “our” means Compelld Inc.  When we refer to “you” or “your,” we mean the individual user of the Compell’d® Application. 

What kinds of information do we collect?

When registering with Compell’d®, you must provide us with your name, email address, and a unique username.  You also have the option to upload a photo, provide the name of your location, and a short personal bio.

To access and use the Compell’d® Application, you must log in to Compell’d® through your registered email address.  

Compell’d® collects certain information automatically, including the type of mobile device used, the device’s ID, and its mobile operating system. Compell’d® will also use the location of your device, but only if you agree by clicking “Always allow” or “Only while using the App” when Compell’d asks you for permission to use the device’s location.  If you do not choose to “Always allow” Compell’d® to use your location, certain location-based features of the Application will not work. Compell’d® will also request your permission to receive notifications, which you may accept by clicking “Allow” when prompted.

After registering, you will be provided an inbox, through which you will receive lists or entries of other users.  It is within your control whether to view such entries or lists.  Additionally, through the inbox, you have the option to share some or all of your entries or lists in Compell’d®. Since sharing requires you to click “share,” this action is completely within your control.  Please note that any content or information that you share publicly can be saved and shared by other users and in such cases, cannot be completely deleted.  Alternatively, if you have configured the Application so that you are a private user, you have the ability to delete all of the content you have shared. 

Compell’d® will collect information about the friends with whom you are connected or sharing and what you are sharing within the Application, [1]  ─so you can decide if you want to follow their lists. We also encourage businesses on Compell’d® to create pages of places and things they love, and want to publish. 

We permit you to integrate your camera or photo gallery on your device and move images into the Application, which enables you to post pictures or content, make collages, and list images.  This integration only occurs with your affirmative consent.  When you choose to move images over to the Application, we store the image.  You are responsible for your use of the Application, and for any Content you provide, including compliance with applicable laws, rules, and regulations.

Compell’d® analyzes the data to understand how the Application is being used. For this purpose, Compell’d® collects the following data automatically:

- Frequency and duration of usage

- Which screens are viewed in the App

- Which buttons are clicked

- Which entries and places are added and shared

- Which entries are completed

- How you interact with friends

How do we use this information?

We use the information you provide us to register and create credentials for you to access the Compell’d® Application.   We use the location information you choose to provide to us for location-based features of our Compell’d® Application.  Any content that you make public through the Compell’d® Application is capable of being saved or shared by other users.  When you add camera integration from your device’s camera or photo album, we use the pictures or content you choose to enable you to post the image, make collages, or list images.  When you make an inquiry of us via e-mail, we use the information you provide to us, such as your name, email address, and any other pertinent information, to answer your questions.  We also use the information that you provide to us, and the information that is collected automatically, to optimize and continuously improve the Application experience and to provide required notices that are essential to providing a good user experience.  Periodically, we will send registered users of the Compell’d® Application e-mail messages to alert such registered users about service outages or other pertinent details directly related to the Compell’d® Application and services. 

“Do Not Track” Signals

The Compell’d® website does not respond or otherwise recognize automated browser signals regarding tracking or “Do Not Track” signals. 

How is this information shared?

Compell’d® shares the information we collect with third parties that perform services for us as part of the services we render to you through the Compell’d® Application.  We use third parties to host our website and data, and to deliver emails and push notifications to our users. 

Apart from the situations stated above, Compell’d® does not share information about its users with other services or companies.

On rare occasions, we may be required to disclose your information as required by law and as necessary to comply with a judicial proceeding, court order, or other legal process served on us. 

In the event that Compell’d®, or substantially all of our assets are sold, or Compell’d® reorganizes or merges into another organization, then customer information, including your personal information would be transferred to another organization.

How can I manage or delete information about me?

Compell’d® will retain the data you provide us in the Application (“User Provided Data”) for as long as you use the Application and for 3 years thereafter, unless you contact us sooner to have your User Provided Data deleted. Any content you have shared publicly, which other users have subsequently saved or shared, cannot be deleted, but such content will no longer be associated with your user account.  If you have configured the Application so that you are a private user, you are able to delete all of your content.  If you’d like us to delete your own User Provided Data from Compell’d®, please make a request to info@compelld.com. Please note that the User Provided Data is required in order for the Application to function properly.  Once your account is deleted, we are not able to restore or otherwise provide you with information regarding that account.  Should you wish to use the Application again, you will need to register as a new user. 

Compell’d® also enables you to deactivate your account, which is an entirely different function from the foregoing deletion procedure.  By choosing to deactivate your account, all information associated with the account is no longer visible to others.  While the information associated with a deactivated account is no longer visible, we will maintain all such data in a hidden state for up to three years following your deactivation, unless you contact us to request deletion.  During the three year period following deactivation, you have the option to re-activate your account at any time, which will enable you to regain access to your account and all the information associated with that account that you enjoyed prior to deactivation.

How do we protect information about you?

We are concerned about safeguarding the confidentiality of your information. We provide electronic and procedural safeguards to protect the information we process and maintain. Only authorized employees and contractors who need the information in order to operate, develop or improve Compell’d® are given access. Please be aware that, although we strive to provide the best security for information we process and maintain, no security system can prevent all potential breaches.

How will we notify you of changes to this policy?

Users will be notified within the Application if any changes are made to this Privacy Policy. If the changes are significant, we will provide a more prominent notice and update your consent. We will also keep prior versions of this Privacy Policy available.

European Union (“EU”) General Data Protection Regulation (“GDPR”) & Data Rights

The GDPR requires that certain information be provided to data subjects (you) when personal data is collected from a data subject. 

  • The Controller of your personal data is Compelld Inc., info@compelld.com.
  • Personal data is processed for the purposes detailed in this Privacy Policy.  The legal basis for the processing that is detailed in this Privacy Policy is by contract and by your affirmative consent.  Your affirmative consent may be withdrawn at any time by deleting the application from your device and contacting us at the address provided in this Privacy Policy.
  • We provide personal data to third parties only as specified in this Privacy Policy pursuant to contracts we have with those third parties.  These third parties are not permitted to use our information except to provide us with the agreed upon services. 
  • Your personal data is stored for as long as you use the Application and for 3 years thereafter, unless you contact us to request deletion of your information.
  • Where personal data is deemed to be mandatory for you to provide us, such as in registering for the Compell’d® Application, this information is necessary in order for us to provide us full access to our product.  If you choose against providing us with this required personal information, you will not be able to utilize the full functionality of the Compell’d® Application.      

Individuals located within the EU are afforded certain data rights, which we must disclose to you:

  • You have the right to request access to and rectification of your personal data.  You have the right to request erasure of your personal data or for a restriction of processing as it concerns you.  You have the right to object to processing and a right to data portability. 
  • You have the right to lodge a complaint against us with a supervisory authority.
  • To the extent the processing of your personal data is based upon your consent, as detailed in this Privacy Policy, you have the right to withdraw your consent and exercise your data rights at any time by contacting us at the address provided in this Privacy Policy.      

At the present time, Compelld Inc.’s operations are not subject to the California Consumer Privacy Act. Therefore, residents of California do not have the rights afforded under such Act. 

Transfers of Personal Data

Compelld Inc. is located within the United States.  To the extent any transfer of personal data is transferred to a third country or international organization, Compelld Inc. will conduct such transfers in accordance with applicable data protection laws, including the execution of Standard Contractual Clauses as approved by the EU Commission.
